SiteOptions Terms of Service
1. ACCEPTANCE OF TERMS
SiteOptions provides services, downloads and premium offerings on our websites as covered in these Terms of Service. SiteOptions may update this document at any time. Use of any siteoptions websites is subject solely to, and conditional upon, the conditions of this document.
2. DESCRIPTION OF SERVICE
SiteOptions provides software, both free and purchased, services, support, information and downloads. Unless otherwise stated all functions of all SiteOptions websites are covered by this ToS.
3. REGISTRATION OBLIGATIONS
In consideration of your use of the SiteOptions website, you represent that you are of legal age to form a binding contract. You also agree to a) Provide accurate, current and complete information where prompted to do so. b) Maintain and promptly update said data to ensure it is always accurate, current and complete. Providing SiteOptions false, inaccurate or misleading information gives SiteOptions reasonable grounds to suspend or terminate your account and/or refuse any future service at the sole discretion of SiteOptions.
4. PRIVACY
Where information is collected about you from the SiteOptions website this is subject to the SiteOptions Privacy Policy.
5. CONDUCT
In using SiteOptions products or services you understand and agree that:
a) You shall not intentionally use Siteoptions products or services to inflict harm on any person or organisation.
b) You shall not use any Siteoptions product or service where doing so may consititue a breach of any code or law that may apply in the your jurisdiction.
c) You shall not use any Siteoptions product or service in a manner for which it was not prescribed by Siteoptions.
6. INDEMNITY
You agree to indemnify and hold SiteOptions and its owners, subsidiaries, affiliates, officers, employees, agents and partners harmless from any claim or demand including but not limited to any legal fees or claim.
7. MODIFICATION
From time to time SiteOptions may make changes to the products or services offered. SiteOptions reserves the right to do this at any time for any reason with or without notice.
8. TERMINATION
You agree that failure to comply with the terms of service herein may result in termination of your account at the sole discretion of SiteOptions.
9. LINKS
Where links exist to other websites from a SiteOptions website no responsibility is taken by SiteOptions for the content of the link. Inclusion of a link on SiteOptions does not constitue an endorsement of any product or service.
10. DISCLAIMER OF WARRANTY
USE OF ANY SITEOPTIONS WEBSITE, SERVICE, OR PRODUCT IS AT YOUR SOLE RISK. ALL PRODUCTS & SERVICES ARE PROVIDED ON AN "AS IS" BASIS. SITEOPTIONS MAKES NO WARRANTY EXPRESS OR IMPLIED INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
SITEOPTIONS MAKES NO GUARANTEE OR WARRANTY THAT ANY SERVICE OR PRODUCT WILL FIT YOUR USE FOR IT.
NO CORRESPONDANCE WHETHER WRITTEN OR VERBAL SHALL CONSTITUTE A WARRANTY OF ANY KIND.
11. LIMITITATION OF LIABILITY
YOU EXPRESSLY AGREE THAT SITEOPTIONS ITS OWNERS, SUBSIDARIES, AFFILIATES, OFFERS, EMPLOYEES, AGENTS AND PARTNERS SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE RESULTING DIRECTLY, INDIRECTLY, INCIDENTALLY, OR CONSEQUENTIALLY FROM THE USE OF SITEOPTIONS PRODUCTS OR SERVICES. THIS INCLUDES BUT IS NOT LIMITED TO ANY LOSS BE IT FINANCIAL, GOODWILL, DATA, INTANGIBLE OR ANY OTHER LOSS.
12. LIMITATION
This document defines the relationship between you and SiteOptions. No partnership or other relationship not covered by this document is to be assumed. The terms of service herein constitues the entire, and supersedes any other, agreement between you and SiteOptions.
The TOS and your relationship with SiteOptions shall be governed by the laws of New Zealand.
FAILURE OF SITEOPTIONS TO ENFORCE ANY PART OF THIS AGREEMENT DOES NOT CONSTITUTE A WAIVER.
